Musk has joined an amicus brief in a case involving an ex CFO who is appealing the SEC's policy of
requiring settling defendants to agree not to deny the SEC’s allegations publicly nor to assert that the government’s complaint was unfounded.

It bypasses the appeals process by going straight to the Supreme Court.

That would still be an appeal, this isn't.

An amicus brief is made by a party who is not a party to proceedings, eg. this isn't his case.

At the time to which this refers, Tesla were negotiating investments from various private sources. Musk concern was that court action against the SEC would jeopardise these negotiations and endanger Tesla due to potential funders walking away. To avoid this risk he settled with the SEC, a settlement that involved paying fines to the SEC which were collected and destined to be distributed to shareholders, but no distribution occurred.

Musk argued this case at a lower court, saying the SEC knew that his funding secure claim was correct but still wanted blood and to avoid risk to Tesla, Musk settled. He lost and is now appealing that decision.

It is incumbent on any CEO to not mislead investors who, if they feel mislead, have recourse to litigation.

With the furnace quote he is being honest. Ramping a new factory is expensive, ask anyone who has started up a new manufacturing plant.

Carnegie had the same issues with his steel plants, but once the plant is up and running then the furnace operates in reverse and spew out far more cash that it consumed in the construction and start up phase.

This is the issue troubling legacy. They want to transition to BEV, but to do so means hurting their ICE business and at the same time consumes a lot of cash. Hence legacy are going slowly, creating small BEV production facilities and praying they can keep their legacy business running too.

The one missing area is storage where Tesla are strong, but the video just discusses generation. Once storage is included the whole picture becomes entirely different & more useful than anything in the previous history of electrical generation.

People keep telling me that hydrogen is the way forward for cars, but this does not look to be the case, although bulk energy storage may be convenient with hydride storage:

I was using the question as a way of showing the fan base for Tesla is different than the fan base for any other car maker. Tesla have created a similar love for their products among consumers as have Apple.

Ha Ha

Elon has more and better birthday wishes than ex-President Trump and it is the former, not the latter, who may get the ex-president back on Twitter.

Although as far as I know ex-president Trump doesn't make cars, or make renewable low carbon energy and in many ways one can argue that the car maker has done more things for humanity than the ex-president, although some unborn who will now get born might argue differently. The world is complicated.

Elon Musk has suddenly stopped tweeting.

It is now more than a week since the Tesla and SpaceX boss posted on the platform that he is trying to buy.

Mr Musk’s last tweet came on 21 June. That was a reply to a post about the fight between SpaceX and FCC over the former’s space internet programme, Starlink.

A day later, on 22 June, Mr Musk liked a number of posts. Some of them were about his attempt to take over Twitter, and others were entirely unrelated.

But since that day, exactly one week ago, Mr Musk has not posted on the platform at all. He made no announcement about a possible departure, and has not explained the silence.

The mystery of no tweets from Elon still continues, almost as though he has been banned.

The ugly threats from Russia & the high availability of guns in the US do add a risk factor that no analyst that I have seen considers.

If Elon was to be taken out the floor for Tesla is highly probably well below the current price.
